
The 22nd September, 2011Order No. 15/284-2010 CO. (1).—In the context of enactment of Right of Children to Free and Compulsory Education Act, 2009 (RTE Act) by the Central Government, the Department has to ensure that elementary classes covering the age group of 6-14 are governed by a uniform structure. Currently classes 6th-8th are being handled by the Directorate of Secondary Education, but now, in the light of RTE Act, 2009 it has been essential to ensure uniformity of approach to ensure delivery of services envisaged under RTE and hence the Directorate of Elementary Education should be in control of classes 1st to VIllth. Various provisions of the Act have to be uniformly applied across classes 1st to VIIIth, viz Section 30) of the Act provides that every child of the age of 6-14 years shall have a right to free and compulsory education in neighbourhood school till completion of elementary edudation. Under Section 6 of theAct, the duty of the State Government would be to provide schooling facilities to the children within a period of 3 years from the commencement of the Act. Not only this, the State Government is required to maintain prescribed teacher pupil ratio (1:30) at primary level and 1:35 at upper primary level. Further, where the admission of children is above 100, a fulltime Head Teacher and part time instructions for Art Education, Health & Physical Education and Work Education would also be required and so on. Under Section 26 of the Act, the Government has to ensure that the vacancies in the school shall not exceed 10% of the total. To give effect to mandatory provisions as contained in the Right of Children to Free & Compulsory Education Act, 2009 (RTE Act, 2009) and the Rules framed there under, the administrative control of Master and C&V Cadre is hereby shifted to the Directorate of Elementary Education, Haryana with immediate effect.
